Are You Ready for the New HIPAA Omnibus Rule?

In what has been referred to by the Health and Human Services (“HHS”) Office of Civil Rights director as “the most sweeping changes to the HIPAA Privacy and Security rules since they were first implemented”, the HIPAA Omnibus Final Rule (“Final Rule”) was issued by HHS on January 17, 2013 and is effective March 26, 2013. The compliance deadline for most obligations is September 23, 2013.  The Final Rule, among other things, strengthens patients’ privacy protections, provides individuals with additional rights to their health information and enhances government enforcement for breaches and violations. As a result of the passage of the Final rule, providers will need to revise their Business Associate Agreements, Notice of Privacy Practices and Policies and Procedures as well as in-service their staff.
